Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the ColdBolt website and SaaS platform (the "Service") operated by ColdBolt ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Accounts & Registration

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

2. Acceptable Use & Anti-Spam Policy

ColdBolt is a tool for professional outreach. We have a zero-tolerance policy for spam. You agree NOT to use the Service to:

  • Send unsolicited messages in violation of applicable laws (such as CAN-SPAM Act, GDPR, CCPA).
  • Send emails to purchased, rented, or scraped lists without consent.
  • Harass, abuse, or harm another person or entity.
  • Distribute malware, viruses, or phishing content.

We reserve the right to immediately suspend your account without refund if we detect suspicious activity or high bounce/complaint rates.

3. Subscriptions & Payments

  • Billing: The Service is billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis (e.g., monthly).
  • Cancellation: You may cancel your Subscription at any time through your account settings. Your access will continue until the end of your current billing period.
  • No Refunds: Except when required by law, paid Subscription fees are non-refundable.
  • Price Changes: We reserve the right to modify pricing at any time. Any price changes will take effect at the start of the next billing cycle.

4. Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of ColdBolt and its licensors. The Service is protected by copyright, trademark, and other laws.

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. COLDBOLT MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE USE OR THE RESULTS OF THIS WEBSITE IN TERMS OF ITS CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE.

We do not guarantee that your emails will land in the inbox (not spam), nor do we guarantee any specific conversion rates or business results.

6. Limitation of Liability

IN NO EVENT SHALL COLDBOLT, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

7. Indemnification

You agree to defend, indemnify, and hold harmless ColdBolt and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from your use and access of the Service, or a breach of these Terms.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which ColdBolt operates, without regard to its conflict of law provisions.

10. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
